Secure Your Brand Before Expanding Across the European Union

Learn how trademark registration in the EU can help international businesses protect their brands across the European market.

Entering several European markets can turn a successful local brand into an international business. As products and services become available across different EU countries, the brand itself becomes an important business asset that deserves protection. For companies planning long-term operations in Europe, Trademark registration in the EU can offer a practical way to protect that asset through a single EU-wide registration.

An EU trade mark, known as an EUTM, is administered by the European Union Intellectual Property Office (EUIPO). Unlike separate national registrations, an EUTM has a unitary character and is intended to have effect throughout the European Union. This makes the system particularly attractive for businesses whose commercial activities extend across several EU markets.

One Registration for a European Market

One of the main advantages of an EUTM is the ability to seek protection across the EU through one centralised application. Instead of approaching individual national intellectual property offices one by one, a business can use the EUIPO system when its strategy calls for EU-wide protection.

This approach can simplify brand management as a company expands. A single registration can cover the trademark in all EU Member States, making it easier to maintain a consistent brand protection strategy while entering new markets.

However, EU-wide registration is not automatically the right choice for every business. Companies operating exclusively in one country may prefer national protection, while businesses with broader European ambitions may benefit from the wider territorial scope of an EUTM. EU and national trademark systems operate alongside each other and can serve different commercial needs.

What to Consider Before Filing

A successful trademark strategy starts well before the application reaches EUIPO. The business should first determine exactly which brand elements need protection and identify the goods or services associated with the trademark.

The choice of classes is particularly important because the protection is connected to the goods and services specified in the application. A business planning future expansion should therefore consider not only what it sells today, but also the commercial direction of the brand.

Availability should also be assessed before filing. Existing trademarks with similar names, designs or commercial coverage can create obstacles during the registration process. The EUIPO procedure includes an examination stage and may also involve opposition proceedings if an earlier right is invoked against the application.

Understanding the EU-Wide Character of Protection

The unitary nature of an EUTM is one of its greatest strengths, but it also makes the system different from a collection of separate national registrations. A problem affecting the trademark in one part of the EU can potentially affect the application or registration as a whole. EUIPO describes this as the “all-or-nothing” principle in certain refusal and invalidity situations.

For this reason, checking the availability and distinctiveness of a proposed trademark across the European market is an important part of preparation. In some circumstances, if an EUTM cannot proceed because of an issue affecting particular Member States, conversion into national applications may provide an alternative route for obtaining protection in unaffected countries.

Maintaining Protection as the Brand Grows

Trademark registration is only one stage of long-term brand management. An EU trade mark is valid for 10 years from the filing date and can be renewed for further 10-year periods indefinitely. The current basic online EUIPO fee is €850 for one class, with additional fees applying for further classes.

Businesses should also pay attention to genuine use. After the applicable five-year period, the owner may need to demonstrate genuine use of the trademark in the EU in certain proceedings. This makes it important to align the registered goods and services with the actual commercial activities of the business.

For international companies, Confidus Solutions can assist with trademark and brand registration matters and help businesses assess an appropriate approach to protecting their intellectual property in Europe.

A well-planned EU trademark strategy can give a growing business a stronger foundation for expansion, while helping protect the name, identity and reputation that customers recognise across European markets.
